New York has adopted Part 395 of the Federal Motor Carrier Safety Regulations (FMCSRs), revised as of October 1, 2022.
Part 395 applies to intrastate and interstate operations when the vehicle has a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or is of any size transporting a placardable amount of hazardous materials.
Exception: Part 395 does not apply to the operation of:
- A commercial motor vehicle owned and operated by a farmer or an employee when used in the hauling of farm, dairy, or horticulture products and farm supplies for the farmer, employee, or farm neighbors to market;
- Tow trucks while responding to requests to provide road service or to remove wrecked, disabled, abandoned, or illegally parked motor vehicles; or
- Utility service vehicles.
New York has adopted the electronic logging device (ELD) requirements in Part 395 for intrastate motor carriers and drivers.
