Colorado has adopted Part 395 of the Federal Regulations.
Part 395 applies to a self-propelled or towed vehicle bearing an apportioned plate or having a manufacturer’s gross vehicle weight rating or gross combination rating of at least 16,001 pounds. Part 395 also applies to a vehicle used on a public highway to transport a placardable amount of hazardous materials.
Exception — Sec. 395.3 or Sec. 395.5 do not apply to Colorado governmental or tow truck drivers working an emergency, as defined in Part 390.
Exception - Sec. 395.3 shall not apply to tow drivers who are towing a vehicle from a public roadway at the request of a police officer for other law enforcement purposes.
Exception — The hours-of-service requirements (Part 395) shall not apply during planting and harvesting season to drivers transporting:
Colorado’s planting and harvesting season is January 1 through December 31.
Drivers transporting livestock, poultry, slaughtered animals or the grain, corn, feed, hay etc. used to feed the animals are also eligible to use this exception.
Colorado has adopted the electronic logging device (ELD) requirements in Part 395 for intrastate motor carriers and drivers.
