Highway Traffic Act
Part II: Permits
(1) Where the fee prescribed by the regulations for a permit or validated permit for a motor vehicle is calculated with regard to specific limitations or restrictions on the use of a vehicle, the owner of the vehicle shall not drive or cause or permit the vehicle to be driven on a highway except in accordance with the limitations or restrictions. R.S.O. 1990, c. H.8, s. 8 (1).
Penalty
(2) Every person who contravenes subsection (1) is guilty of an offence and on conviction is liable to a fine of not less than $100 and not more than $500. R.S.O. 1990, c. H.8, s. 8 (2).
Note: On a day to be named by proclamation of the Lieutenant Governor, section 8 of the Act is repealed and the following substituted: (See: 2020, c. 34, Sched. 23, s. 7 (4))
Permit limitations re use of motor vehicle
Limitations or restrictions
8 (1) No person shall drive or permit the operation of a motor vehicle on a highway except in accordance with any limitations or restrictions on the use of a motor vehicle under the class of permit issued for the motor vehicle. 2020, c. 34, Sched. 23, s. 7 (4).
Prescribed class of permit for specified uses
(2) No person shall drive or permit the operation of a motor vehicle on a highway if the motor vehicle is being used in a way that is required by the regulations to have a specified class of permit unless the permit for the motor vehicle is of the prescribed class. 2020, c. 34, Sched. 23, s. 7 (4).
Penalty
(3) Every person who contravenes subsection (1) or (2) is guilty of an offence and on conviction is liable to a fine of not less than $250 and not more than $20,000 and, in addition, the person's driver's licence may be suspended for a period of not more than one year. 2020, c. 34, Sched. 23, s. 7 (4).
