Kentucky Occupational Safety and Health (Kentucky OSH) standards are a combination of state-specific standards, OSHA standards incorporated with state-specific provisions, and OSHA standards incorporated by reference. Kentucky OSH incorporates federal standards around machine guarding and lockout/tagout, both of which apply to conveyors, with some minor differences.
Machine guarding
Kentucky adopts the federal machinery and machine guarding standards at 29 CFR 1910 Subpart O, with some minor changes to definitions. The relevant state law is at 803 KAR 2:314.
Lockout/tagout
Under Kentucky state law 803 KAR 2:309, 29 CFR 1910.147(c)(2)(ii) is amended to read: “(1)(b) If an energy-isolating device is capable of being locked out, the employer's energy control program under 29 CFR 1910.147(c)(1) shall utilize lockout.”
29 CFR 1910.147(c)(3)(i) is amended to read: “(2)(b) If a tagout device is used on an energy-isolating device that is incapable of being locked out, the tagout device shall be attached at the same location that the lockout device would have been attached and the employer shall demonstrate that the tagout program shall provide a level of safety equivalent to that obtained by using a lockout program. (2)(c) If a tagout device is used with an energy isolating device that is incapable of being locked out, the tagout device shall be fastened at the same point at which the lock would have been attached.”
