North Dakota law gives the state Labor Commissioner the right to determine whether a worker is an employee or an independent contractor. Workers who plan to work as independent contractors may apply to the commissioner to receive verification of their IC status, and the commissioner will issue a determination to the applicant, along with an identification number that becomes invalid if the applicant’s job changes. Applicants may reapply for IC status when a job changes or a new job begins.
Employee: Any individual employed by an employer.
