In Indiana, independent contractors are not considered to be employees who are protected by Indiana wage law.
The Indiana Dept. of Labor says that the state uses IRS criteria to determine whether a worker is an employee or an IC. The department instructs workers to request IRS form SS-8 to help determine their status.
Employee: Any person employed or permitted to work or perform any service for remuneration or under any contract of hire, written or oral, express or implied by an employer in any occupation.
Independent contractor: A person engaged in an independently established trade, occupation, profession, or business who, in performing the services in question, is free from control or direction both under a contract of service and in fact.
