Arizona’s minimum wage law relies on the federal FLSA in determining independent contractor status. A worker who is an independent contractor can execute a Declaration of Independent Business Status to help strengthen the case for contractor status.
Employee: Any person who is or was employed by an employer but does not include any person who is employed by a parent or a sibling, or who is employed performing babysitting services in the employer’s home on a casual basis.
Independent contractor: Whether a person is an independent contractor or an employee is determined according to the standards of the federal FLSA, but the burden of proof shall be upon the party for whom the work is performed to show independent contractor status by clear and convincing evidence.
