Summary of differences between federal and state regulations
The federal Fair Labor Standards Act contains certain provisions in regard to compensation in terms of minimum wage, overtime, child labor and recordkeeping requirements. Corresponding state provisions will be found under those topic areas. States are free to adopt additional provisions that are not regulated by the federal government such as frequency of payday and wage deductions. These provisions are discussed in this section.
Frequency of payday
Employers are to pay wages at least twice monthly on regular paydays and no later than 11 days after the end of the pay period. Government employees and exempt employees may be paid monthly. §40-165.2
Itemized statement
Employers must provide employees with an itemized statement of all deductions with each paycheck. Oklahoma Statutes Title 40, §40-165.2
Authorized deductions
An employer can not deduct from an employee’s wages unless allowed by law or court order, or voluntarily agreed to by the employee for the following: To repay a loan or advance, to recover from an overpayment of wages, to pay for merchandise or uniforms purchased by the employee, for medical or retirement benefits, insurance (not including workers’ compensation or unemployment compensation insurance), for deferred compensation plans, for breakage or loss of merchandise, cash or inventory shortages solely caused by the employee. Any payroll deduction agreement must be in writing and signed by the employee and employer. §380:30-1-7.
Deduction for medical exam
An employer can not deduct from an employee’s wages costs associated for a medical exam required by the employer as a condition of employment. §40-191
