Summary of differences between federal and state regulations
The federal Fair Labor Standards Act contains certain provisions in regard to compensation in terms of minimum wage, overtime, child labor and recordkeeping requirements. Corresponding state provisions will be found under those topic areas. States are free to adopt additional provisions that are not regulated by the federal government such as frequency of payday and wage deductions. These provisions are discussed in this section.
Frequency of payday
Employers are to pay wages semimonthly and no later than the 15th day of the month for wages earned between the 16th and the end of the previous month, and not later than the last day of the month for wages earned between the first and the 16th of the month.
Employers and employees can contract for more frequent pay intervals. Nevada Revised Statutes Chapter 608, §608.060
Notification
Employers shall post notices of regular paydays and place of payment. Changes can be made only with seven days’ prior notice. §608.080
Unlawful to pay lower wage
It is unlawful for an employer to pay a lower wage than earned or contractually required, or to require a refund or return of any wages paid to the employee, or reduce an employee’s wages without seven days’ prior written notice. §608.100
Authorized deductions/itemization
Deductions must be authorized in writing by the employee, and must be itemized in writing with each paycheck. §608.110
Deduction for meals
A portion of wages may consist of meals if agreed upon by contract between the employer and employee. §608.155
Deduction for uniforms
No deductions from wages may be made for uniforms or cleaning of uniforms required by the employer. §608.165
Unauthorized deductions
An employer may not make deductions from an employee’s wages to cover any part of the employer’s required contributions to the unemployment compensation fund. Chapter 612, §612.700
It is unlawful for an employer to deduct from an employee’s wages to cover part or all of the employer’s costs for industrial insurance (workers’ compensation). Chapter 616D, §616D.240
