Summary of differences between federal and state regulations
The federal Fair Labor Standards Act contains certain provisions in regard to compensation in terms of minimum wage, overtime, child labor and recordkeeping requirements. Corresponding state provisions will be found under those topic areas. States are free to adopt additional provisions that are not regulated by the federal government such as frequency of payday and wage deductions. These provisions are discussed in this section.
Indiana law contains the following provisions:
Frequency of payday
Any employer engaged in mining, quarrying, or manufacturing must pay employees at least every two weeks. Employers and employees can contract for weekly pay periods. §22-2-4-1
Every employer doing business in Indiana must pay its employees at least semimonthly or biweekly by employee request. Payment shall be made no later than 10 days after the end of the pay period. §22-2-5-1
Wage assignment
A wage assignment, or authorized deduction of wages by an employee, must be in writing, signed by the employee, revocable by the employee in writing at any time, and agreed to in writing by the employer. Wage assignments may be made for insurance, charity, purchasing bonds or securities issued by the U.S., to purchase stock of the employer, union dues, to purchase employer merchandise, health insurance, to pay a loan, and others listed. §22-2-6-2
Overpayment of wages
In the case of overpayment of wages, the employer can deduct the amount from the employee’s check upon two weeks’ notice to the employee. An employer may not deduct more than 25% of an employee’s disposable earnings for any work week. An employer may not deduct any amount in dispute. §22-2-6-4
Deduction for fine
An employer may not assess a fine against an employee on pretext and deduct the amount of the fine from the employee’s wages. §22-2-8-1
Statement
Every employer shall furnish to each employee a statement of the hours worked and the wages paid to the employee listing the deductions for each pay period. §22-2-2-8
