The driver of a vehicle either directly or indirectly involved in an accident is subject to certain requirements under the Motor Vehicles Act.
The driver must stop at or immediately return to the scene of the accident, render reasonable assistance to any injured persons, and provide, in writing, the following information to all others involved in the accident, including peace officers and witnesses:
- Name and address;
- Driver’s licence number;
- Vehicle registration number;
- Name and address of the vehicle’s registered owner; and
- Statement of financial responsibility (insurance card).
Where the accident involves an unattended vehicle or results in damage to property, the driver must attempt to locate the owner and provide the owner with the required identification information. In the case of unattended vehicles, if the owner cannot be located, the driver must leave written notice in a conspicuous place in or on the vehicle.
A written report in the prescribed form must be made by the driver if the accident involves injury or death to a person or property damage that appears to exceed $1,000.
Where the driver is incapable of making the report or providing notification, it may be done by an occupant of the vehicle.
