South Dakota has adopted Part 393 of the Federal Motor Carrier Safety Regulations (FMCSRs), as amended through January 1, 2024.
Note: Effective July 1, 2025, South Dakota has adopted Part 393 of the FMCSRs, as amended through January 1, 2025.
The adoption includes regulations dealing with projecting loads (393.87) and cargo securement (Part 393, Subpart I).
Part 393 applies to drivers and motor carriers operating intrastate vehicles and combinations of vehicles with three or more axles or with a gross vehicle weight rating of 26,001 or more pounds, and any size or type of vehicle used to transport hazardous materials requiring placarding.
In South Dakota, no person may drive or move any vehicle on any highway unless the vehicle is so constructed or loaded as to prevent its contents from dropping, sifting, leaking, or otherwise escaping.
