Nevada has adopted Part 393 of the Federal Motor Carrier Safety Regulations (FMCSRs), and subsequent revisions.
The adoption includes regulations dealing with projecting loads (393.87) and cargo securement (Part 393, Subpart I).
Part 393 applies to intrastate vehicles with a gross vehicle weight, gross vehicle weight rating, gross combination weight rating, or gross combination weight of 26,001 or more pounds, or any vehicle transporting hazardous materials as defined in NRS 459.7024.
In Nevada, no vehicle may be driven or moved on any highway unless it is constructed or loaded to prevent any of its load from dropping, sifting, leaking, or otherwise escaping.
In addition, no person may operate on any highway any vehicle unless its load and any covering are securely fastened to prevent the covering or load from becoming loose, detached, or in any manner a hazard to other users of the highway.
This requirement does not apply to:
- The dropping of sand for the purpose of securing traction, or
- The sprinkling of water or other substances for cleaning or maintaining a roadway.
