Kansas has adopted Part 393 of the Federal Motor Carrier Safety Regulations (FMCSRs), as in effect on October 1, 2022.
The adoption includes regulations dealing with projecting loads (393.87) and cargo securement (Part 393, Subpart I).
Part 393 applies to vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or vehicles transporting hazardous materials requiring placarding.
Exception: Private motor carriers domiciled in Kansas operating vehicles with a GVWR, GCWR, GVW, GCW of 10,001 lbs. to 26,000 lbs. must comply with Part 393, Subpart F (coupling devices) and Part 393, Subpart I (load securement) and are exempt from compliance with the rest of Part 393. This exemption does not apply to motor vehicles which are used in the transportation of hazardous materials and required to be placarded.
In Kansas, vehicles must not be driven or moved on any highway unless the vehicle is so constructed or loaded as to prevent any of its load from dropping, sifting, leaking, or otherwise escaping.
In addition, no person may operate on any highway any vehicle with any load unless the load and any covering are securely fastened to prevent the covering or load from becoming loose, detached, or in any manner a hazard to other users of the highway.
This requirement does not apply to:
- The necessary spreading of any substance in highway maintenance or construction operations; or
- Trucks, trailers, or semitrailers when hauling agricultural forage commodities (grasses and legumes) intrastate from the place of production to a market or place of storage or from a place of storage to a place of use. This agricultural exception does not apply if the trucks, trailers, or semitrailers are hauling:
- Hay bales, or
- Other packaged or bundled forage commodities.
