Yes, companies can reward employees who have been vaccinated against COVID-19.
The Equal Employment Opportunity Commission (EEOC) notes that federal law does not prohibit an employer from offering incentives to employees who voluntarily provide proof that they have been vaccinated outside the workplace. The employee may have received the vaccine at a pharmacy, at a doctor’s office, or at a public health clinic, for example.
If an employer chooses to obtain vaccination information from employees, the EEOC notes that this information must be kept confidential. This is a requirement under the Americans with Disabilities Act (ADA).
An incentive may trigger tax obligations. In addition, if the company is providing a vaccination to employees, there are limits on the incentive that can be provided.
The EEOC notes that if employees are rewarded for receiving a vaccine from the employer, the reward cannot be so large that is considered “coercive.”
