No. Unless an employee is covered by a federal law requiring disqualification, an employee who legally uses opioids cannot automatically be disqualified from consideration for a job.
An employer must first consider whether there is a way for the employee to do the job safely and effectively. The employer may have to provide a reasonable accommodation under the Americans with Disabilities Act (ADA).
