Part 40 alcohol testing procedures call for the use of an evidential breath testing device (EBT). Any EBT used must have been approved by the National Highway Traffic Safety Administration (NHTSA) and placed on NHTSA’s “Conforming Products List of Evidential Breath Measurement Devices.”
NHTSA’s latest list of EBT devices appeared in the Federal Register on November 2, 2017.
