Oregon incorporates by reference the federal regulations for bloodborne pathogens; therefore, the state requirements are identical to the federal requirements, except for some additions and revisions. A summary of the differences includes the following:
- Oregon does not adopt federal OSHA 1910.1030(c)(1)(v). Instead, Oregon Administrative Rule 437-002-1030 has more stringent mandates for employers that use medical sharps in direct patient care.
- Oregon requires that ANY employer who must keep an exposure control plan must also establish and maintain a sharps injury log. This is more stringent than federal OSHA, which only requires employers who must maintain injury/illness logs under 29 CFR 1904 to establish and maintain a sharps injury log.
