New York follows the federal OSHA Bloodborne Pathogens Standard (29 CFR 1910.1030 and Appendix) for this topic for private-sector employers.
However, public-sector employers are covered under the New York Public Employee Safety & Health (PESH) state plan, which adopts by reference the federal OSHA Bloodborne Pathogens Standard, June 1, 2016, edition. Based on the edition date, that means, for public-sector employers, New York has not yet adopted the federal OSHA May 14, 2019, Standards Improvement Project - Phase IV final rule. So public-sector employers must still keep a record of the name of the employee AND social security number, per 1910.1030(h)(1)(ii)(A), as part of the medical record of an employee with occupational exposure.
