Summary of differences between federal and state regulations
Arrest & conviction record inquiries
Applies to private employers with 15 or more employees, and to public employers. Opportunity to Compete Act, effective March 1, 2015. Amended December 20, 2017.
A covered employer may not make any oral, written, or online inquiry regarding an applicant's criminal record prior to conducting the first interview, whether in person or by other means. After the initial interview, such inquiries are allowed. Exceptions are also provided for certain positions such as law enforcement. Employers also may not publish job advertisements indicating that individuals with convictions will not be considered. Employers are prohibited from asking about expunged criminal records during the initial application process.
