Summary of differences between federal and state regulations
There is no one federal law that specifically addresses employment applications, although there are record retention guidelines under a variety of federal laws (see the Recordkeeping topic) and non-discrimination provisions for hiring in general (see the Discrimination topic”).
An employer can not discriminate in terms of application and hiring procedures and other conditions of employment in regard to race, color, religion, sex, national origin, age, disability, marriage status, public assistance status, or participation in lawful activities off premises during non-working hours which don’t conflict with the employer’s legitimate business interests.
