Summary of differences between federal and state regulations
There is no one federal law that specifically addresses employment applications, although there are record retention guidelines under a variety of federal laws (see the Recordkeeping topic) and non-discrimination provisions for hiring in general (see Discrimination topic).
Salary history inquiries
The Clarke-Figures Equal Pay Act (CFEPA) does not bar employers from inquiring about applicants’ salary histories at any point; however, it does prohibit employers from retaliating against (by refusing to interview or hire) candidates who decline to provide such information. The CFEPA applies to employers of all sizes, both public and private.
