Arkansas currently does not have a state law regulating private employers’ use of AI in employment decisions.

Act 848, passed in 2025, requires state entities (such as state agencies, local governments, and public school systems) to develop official policies around the use of artificial intelligence and automated decision tools in the workplace. The policies must include definitions of artificial intelligence and automated decision tools that align with the Act’s definitions. The Act also requires that, even if AI or an automated tool recommends an action, the final decision whether to carry out that action must be made by an authorized human employee or designee.
