(a) The regulations in this part apply for all new heavy-duty vehicles, except as provided in §1037.5. This includes battery electric vehicles, fuel cell electric vehicles, and vehicles fueled by conventional and alternative fuels.
(b) The provisions of this part apply for alternative fuel conversions as specified in 40 CFR part 85, subpart F.
(c) This part establishes criteria pollutant and evaporative and refueling standards as described in §1037.101. This part does not establish standards for CO 2 or other greenhouse gas emissions, but it includes certification and testing provisions related to CO 2 emissions to support the fuel consumption standards for heavy-duty vehicles adopted by the Department of Transportation's National Highway Traffic and Safety Administration (NHTSA) under 49 CFR part 535.
