Any employer with 50 or more employees and all public agencies and schools must offer their employees FMLA. Employees are eligible for FMLA leave if they:
Work for an employer covered by the law,
Have worked for the employer for at least 12 months as of the date FMLA leave is scheduled to begin,
Have worked at least 1,250 hours for the employer during the 12-month period immediately before the first day of leave, and
Work in a location where there are at least 50 employees within 75 miles of that worksite.
