Any employer with 50 or more employees and all public agencies and schools must offer their employees FMLA. Employees are eligible for FMLA leave if they:
- Work for an employer covered by the law,
- Have worked for the employer for at least 12 months as of the date FMLA leave is scheduled to begin,
- Have worked at least 1,250 hours for the employer during the 12-month period immediately before the first day of leave, and
- Work in a location where there are at least 50 employees within 75 miles of that worksite.
