Eligible employees can take up to 12 weeks of job-protected leave in a 12-month period. Employees are eligible for leave under the law if they:
- Work for an employer with 50 or more employees or for a public agency or school,
- Have worked for the employer for at least 12 months as of the date FMLA leave is to begin,
- Have worked at least 1,250 hours for the employer during the 12-month period immediately before the first day of leave;and
- Work in a location where there are 50 employees within 75 miles of that worksite.
