Section 172.202 establishes the general requirements for the description of hazardous materials on shipping papers.
Question/Dilemma
In this scenario, a carrier inquires if a driver must create a new shipping paper or revise an existing shipping paper to reflect partial delivery of a product. For example, the driver transports 10 drums and only delivers two. The carrier asks if the driver must change the shipping paper to indicate that there are only eight drums on the transport vehicle. The carrier also asks if the driver is required to present a shipping paper to the consignee of a hazardous material upon delivery.
In this interpretation, PHMSA addresses if partial deliveries affect hazardous materials shipping papers.
Interpretation summary
In interpretation Ref. No. 03-0247, PHMSA advises that a driver is not required to update a shipping paper to reflect partial delivery.
- If a driver picks up additional quantities of hazardous materials, which were not previously indicated on the shipping paper, the additional quantities must be added on the shipping papers.
- A driver is not required to present a shipping paper upon delivery. Each person who offers a hazardous material for transportation shall describe that hazardous material on the shipping paper and present it to the carrier.
