OSHA’s federal Heat Injury and Illness Prevention rule may only be proposed at this point; however, some states like California, Colorado, and Minnesota currently have regulations which clearly indicates heat as a recognized hazard that every employer will want to circumvent. The proposed standard would apply to all employers conducting outdoor and indoor work in all general industry, construction, maritime, and agriculture sectors under OSHA’s jurisdiction. Until then, employers must protect workers according to applicable heat emphasis programs and the General Duty Clause.
