Nevada law requires medical facilities to follow certain procedures to prevent workplace violence. The following are considered medical facilities for purposes of the law:
- A hospital;
- A psychiatric hospital;
- An agency that provides nursing care in the home and has at least 50 employees;
- An independent center for emergency medical care;
- A facility for intermediate care;
- A facility for skilled nursing;
- A facility for modified medical detoxification; or
- A community triage center.
Employers at such facilities are required to implement the following:
- Establish a workplace safety committee, made up of employees from all major areas of the medical facility.
- Develop a plan for prevention of and response to workplace violence, in collaboration with the workplace safety committee. The plan must be in writing and be in effect at all times. Employees must have access to the plan. The plan must include specifics for each unit, area, and location maintained by the medical facility. The plan must include requirements for:
- Assessing hazards;
- Responding to and investigating incidents;
- Procedures for correcting hazards that increase the risk of workplace violence, including engineering and work practice controls;
- Procedures for obtaining assistance from security or public safety agencies when needed;
- Procedures for responding to active shooters and other mass casualty threats.
- Provide training for employees, including:
- An explanation of the safety plan;
- How to recognize threats in the workplace;
- When and how to respond to and seek assistance to prevent to violence;
- De-escalation techniques;
- How to report incidents of workplace violence;
- An explanation of available resources for employees who have been exposed to violence in the workplace.
- Report to Nevada OSHA any instances of violence involving the use of physical force, a firearm or other dangerous weapon, or that presents a realistic possibility of death or serious physical harm. An electronic submission form is available on the Nevada Division of Industrial Relations website.
- Create and maintain records of incidents of workplace violence, and annually submit a report of the most current incidents to the DIR.
