New York has adopted federal OSHA standards by reference. New York’s Public Employees Safety and Health (PESH) Bureau standards apply to state and local government workers. Federal and private sector employers must follow federal OSHA standards. PESH does not have additional requirements for work zones, flaggers, signals, and barricades.
Note that some states have requirements for work zones and flaggers that fall under the state’s Department of Transportation regulations, in addition to the OSHA-related requirements listed here.
