Nevada operates an OSHA-approved State Plan covering most private sector workers and all state and local government workers. Nevada has adopted Nevada OSHA has incorporated most OSHA standards by reference.
Nevada, however, signed into law Senate Bill (SB) 260 on June 10, 2025 which requires employers to reduce employee exposure during high Air Quality Index (AQI) levels. The SB applies to outdoor work environments and requires employers with more than 10 employees to protect workers from poor air quality due to wildfire smoke where the AQI is: (1) 150 or more but less than 200; and (2) 200 or more.
In addition to reducing or eliminating employee wildfire smoke exposure, employers must also:
- Establish which employees may be prohibited from a performing critical tasks outdoors during periods of poor air quality.
- Train employees on:
- Wildfire smoke hazards and controls;
- AQI levels; and
- Signs and symptoms of wildfire smoke exposure.
- Establish a communications system that:
- Informs an employee when they are being exposed to certain poor air quality; and
- Allows any employee to report the presence of such poor air quality and/or any signs or symptoms experienced by the employee from the exposure.
