The Transportation Security Administration (TSA), which is under the Department of Homeland Security (DHS), is working with individual state agencies that issue CDL licenses. The TSA will conduct thorough background checks on drivers obtaining, renewing, or upgrading to a hazmat endorsement.

Many motor carriers mistakenly have thought that they would be responsible for this security-related investigation.Carriers, however, are still responsible for the necessary employment verifications found in 391.23 and the drug and alcohol testing information required in 40.25.
