Avoid questions that relate to how often the applicant used drugs in the past, which might indicate that the applicant was a drug addict. A person in recovery from substance abuse is protected by the ADA. The EEOC indicated that problematic questions include:
- How often did you use illegal drugs in the past?
- Have you ever been addicted to drugs?
- Have you ever been treated for drug addiction?
- Have you ever been treated for drug abuse?
