The specific chemical identity, including the chemical name and the exact percentage or concentration range of the substance in a mixture, can be withheld from the safety data sheet if it is claimed as a trade secret. However, certain conditions must be met, such as:
- Disclosing information about the properties and effects of the hazardous chemical.
- Indicating that the specific chemical identity or concentration is being withheld as a trade secret.
- Providing the ingredient's concentration as one of the prescribed ranges found at 29 CFR 1910.1200(i)(1)(iv)(A) through (M).
The narrowest range possible should be used, and if the exact concentration range does not fit entirely into one of the prescribed ranges, a combination of two applicable consecutive ranges can be disclosed. Manufacturers also have the option to provide a narrower range than the prescribed ranges.
