The National Electric Code states that if a receptacle serves the counter top surface, such as near a sink, then it needs to be GFCI protected (Article 210.8(A)(6)).
Receptacles installed under the sink, usually for disposals, dishwashers, and trash compactors, are not required to be GFCI protected.
