Private carriage exists when:

  1. Property is transported by a person engaged in a business other than transportation; and
  2. The transportation is within the scope of, and furthers a primary business (other than transportation) of the person.

Private carriers may only transport their own goods in their own vehicles to further a primary business that is not trucking. Hauling goods for someone else for compensation requires for-hire operating authority.
