What if a CDL driver refuses to sign a statement certifying a copy of the policy was received?
It is ultimately the motor carrier’s responsibility to ensure that drivers sign a statement certifying that they have received a copy of the materials required in 382.601. If the motor carrier allows the driver to perform a safety-sensitive function without the signed receipt for the policy, it is in violation. The employee would not be in violation since the requirement is placed on the employer.
