Delaware law requires all motor vehicles, truck tractors, trailers, motorcycles, mopeds, mobile homes, and house trailers to be titled in Delaware prior to the vehicle being registered to operate on Delaware highways. Off-highway vehicles and all-terrain vehicles are required to be registered at the Delaware Division of Motor Vehicles (DMV) but not titled.
Delaware law also requires all buyers of Delaware-registered vehicles to make application for a new certificate of title immediately following the purchase of the vehicle. If not completed immediately, the buyer must apply no more than 30 days after the purchase of the vehicle or a penalty fee will be charged.
To complete the application to receive a new or used car title, vehicle owners must provide the following information:
- The name, address, and email address of the applicant;
- A description of the vehicle, including the vehicle's odometer brand, odometer reading, title brand, and vehicle identification number (VIN);
- The vehicle's make, model, year, body style, color, and fuel type;
- The automobile's registration weight, yearly fee, gross vehicle weight rating, and purchase date;
- The name of the vehicle inspector and the date of the vehicle inspection; and
- Lien information (if applicable).
In addition to completing a vehicle title application, a car owner must submit other supporting documentation as well. To obtain a Delaware certificate of title, a motorist must submit the following information to the DMV:
- A manufacturer's statement of origin or an original out-of-state title;
- The car dealer's bill of sale;
- Proof of identity, including the vehicle owner's driver's license or two proofs of state residency;
- Proof of liability insurance (original documents only); and
- Proof of completing a vehicle inspection.
Other relevant information includes:
- In addition to the title fee, there is also a document fee imposed on the title;
- Physical inspections are required as part of the registration or renewal process, except for Delaware-registered vehicles in the five most recent model years; and
- The newest seven model years of vehicles, weighing 10,000 pounds or less and being titled for the first time in Delaware may only be required to have a VIN inspection.
