Application
Every carrier must establish a periodic system to inspect, repair and maintain all commercial motor vehicles under its control.
Requirements
Carriers must ensure that parts and accessories which affect the safety of the operation of a commercial vehicle are in safe and proper operating condition that replacement parts are designed for the application for which those parts are used and properly installed. If practical, the carrier must ensure that replacement parts certified by a recognized standards testing organization are used.
Recordkeeping
Carriers must maintain in relation to commercial vehicles:
- Records identifying the vehicle, including the company number, make, model, identification plate number, serial number, year and tire size;
- A record of the name of the owner of the vehicle, if the vehicle is not owned by the carrier;
- A means to indicate the nature and due date of the various inspection and maintenance operations to be performed;
- A record of inspections, repairs and maintenance indicating the date and nature of the inspections, repairs and maintenance;
- A lubrication record; and
- A record of modifications involving axles or suspensions which affect a manufacturer's gross vehicle weight rating or gross axle weight rating.
Carriers must retain required records at the location that the commercial vehicle is housed or maintained and are required retain those records for a period of two years and for six months after the vehicle leaves the carrier's control.
