Summary of differences between federal and state regulations
Coverage
Wyoming state law covers employers of one or more workers at any time.
Workers are considered employees unless the worker is free from control or direction in the performance of the work under the contract of service and in fact. Also, individual must represent services to the public as being in self-employment or as an independent contractor and individual must be able to substitute another individual to perform the services.
Real estate agents on commission are excluded from the definition of employment.
Students working for schools are excluded from coverage.
