Summary of differences between federal and state regulations
The federal Fair Labor Standards Act does not require payment for time not worked, nor does it regulate vacation pay, holiday pay, or other paid time off. These types of benefits are generally a matter of agreement between an employer and an employee (or the employee’s representative). Employers, however, do need to comply with applicable state laws.
Attend court
Pennsylvania law provides that employers must not deprive an employee of his or her employment, seniority position, or benefits, or threaten or otherwise coerce him or her, because the employee attends court as a victim of, or a witness to, a crime. Employers are not required to compensate the employee for employment time lost because of such court attendance.
Violation of the law may bring a civil action for recovery of wages and benefits lost as a result of the violation and for an order requiring the reinstatement of the employee.
Jury duty
Pennsylvania law doesn’t require private employers to pay employees for jury duty.
Organ/bone marrow donation
Pennsylvania has no state family and medical leave provisions. However, if employers provide one or more paid leaves of absence to employees for the specific purpose of organ or bone marrow donation, the employers will qualify for the organ or bone marrow donor tax credit.
Paid time off (PTO)
Pennsylvania law does not require vacation pay. However, if an employer chooses to provide paid time off benefits, it must follow the terms and conditions established in its policy.
Pregnancy disability
If you have practices or policies regarding job benefits and security, they must be applied due to pregnancy or childbirth on the same terms and conditions as they are applied to other temporary (or permanent) disabilities. If you have a policy or practice allowing employees leave for purposes of childrearing and child care, the leave must be equally applicable to both male and female employees, and in relation to birth or adoption.
Voting
Pennsylvania doesn’t have a time-off-for-voting provision.
