Summary of differences between federal and state regulations
The Hawaii Department of Labor and Industrial Relations administers and enforces civil rights and labor standards which have been enacted for the protection of state workers.
The state law excludes from coverage any employment that is subject to the Federal Fair Labor Standards Act unless the State wage rate is higher than the Federal.
The state law lists exemptions for learners, apprentices, wards paroled from youth correctional facilities, or individuals whose earning capacity is impaired by old age or physical or metal deficiency or injury.
