Surface Water Discharge permits are required for any point source that is discharging pollutants to waters of the state, with some exemptions.

An application for a Surface Water Discharge or Pretreatment Industrial User permit should be sent to the department at least 180 days prior to any discharge. The regulations can be found in the Administrative Rules of South Dakota 74:52.
