Smoking on or near any vehicle containing any Class 1 (explosive), Class 3 (flammable liquid), Class 4 (flammable solid), Class 5 (oxidizer), or Division 2.1 (flammable gas) materials while loading or unloading is forbidden.
Scope
Smoking rules apply to all employee working with or near Class 1, Class 3, Class 4, Class 5, or Division 2.1 materials, especially while loading or unloading.

Summary of requirements
Care should be taken to keep all fire away and prevent persons in the vicinity from smoking, lighting matches, carrying any flame or lighted smoking materials when loading or unloading any of the above materials.
Section 397.13 specifies that no person may smoke or carry any lighted smoking materials on or within 25 feet of marked or placarded vehicles containing any Class 1 (explosive) materials, Class 5 (oxidizer) materials or flammable materials classified as Division 2.1, Class 3, Divisions 4.1 and 4.2, or any empty tank vehicle that has been used to transport Class 3 (flammable) liquid or Division 2.1 (flammable gas) materials.
Smoking and any other source of ignition in the vicinity of a leaking cargo tank is not permitted.
