If the line becomes blurry on the question of “employee vs. independent contractor,” a court will look at factors such as who has the right to direct or control the worker’s daily activities. Having an independent contractor sign a job description could send the wrong message. It’s likely best to avoid having independent contractors complete the same paperwork that would be completed by employees.
