Individual states promulgate laws to comply with the federal law — The Personal Responsibility and Work Opportunity Reconciliation Act of 1996. This act is codified at 42 USC 653-653A. Employers need to only comply with state laws.
South Dakota Codified Law 25-7A-3.3 requires employers to report new hires within 20 days of their first day at work. If the report is transmitted electronically by magnetic tape or diskette, employers must report twice monthly, not less than 12 or more than 16 days apart.
