Summary of differences between federal and state regulations
The Nevada Equal Rights Commission enforces the discrimination provisions of Title VII of the Civil Rights Act. The state statutes and regulations mostly provide authority for the Commission regarding enforcement. The statute contains a simple declaration of public policy, as follows:
“It is hereby declared to be the public policy of the State of Nevada to protect the welfare, prosperity, health and peace of all the people of the State, and to foster the right of all persons reasonably to seek, obtain and hold employment and housing accommodations, and reasonably to seek and be granted services in places of public accommodation without discrimination, distinction or restriction because of race, religious creed, color, age, sex, disability, national origin or ancestry.”
Mandatory “new age” training programs, designed to improve employee motivation, cooperation or productivity through meditation, yoga, biofeedback or other practices, may conflict with the non-discriminatory provisions of Title VII. Employers must accommodate any employee who gives notice that these programs are inconsistent with the employee’s religious beliefs, whether or not the employer believes there is a religious basis for the employee’s objection.
