Virginia Waste Management Board has incorporated by reference the federal Hazardous Materials Regulations (HMR) and the Federal Motor Carrier Safety Regulations, Title 49, Code of Federal Regulations (CFR), Parts 107 (Subparts B & G), 171-180, and 390-397, with all federal amendments implemented through October 1, 2013. Every person who transports, or offers for transportation, hazardous materials within or throughout the Commonwealth of Virginia must comply with this adoption. The latest amendment to the Virginia regulations has been in effect since October 1, 2013.
The Virginia State Police (VSP), Safety Division, enforces regulations regarding the transportation of hazardous materials and waste within the state.
The Virginia Department of Environmental Quality (DEQ) is the lead agency in developing and administering the hazardous waste management program within Virginia.
The Chesapeake Bay Bridge-Tunnel District has specific regulations for the transportation of hazardous materials over the Chesapeake Bay Bridge-Tunnel (Route 13).
The Virginia Department of Transportation has regulatory control over the transportation of hazardous materials on the following bridge-tunnel facilities: Big Walker Mountain Tunnel (Interstate 77), East River Mountain Tunnel (Interstate 77), Elizabeth River Tunnel Downtown (Interstate 264), Elizabeth River Tunnel-Midtown (Route 58), Hampton Roads Bridge-Tunnel (Interstate 64), and Monitor-Merrimac Memorial Bridge-Tunnel (Interstate 664).
