South Dakota adopted the federal Hazardous Materials Regulations (HMR), Title 49, Code of Federal Regulations (CFR), Subtitle B, Chapter I, Subchapter A, Part 107 (Subparts F & G only) and Subchapter C; Parts 171 – 180; Subtitle B, Chapter III, Subchapter B, Part 387, as well as Parts 390 – 397 of the Federal Motor Carrier Safety Regulations, as amended through January 1, 2013. The adoption has been in effect since July 1, 2013.
The South Dakota Highway Patrol exercises regulatory control over the transportation of hazardous materials within the state.
The South Dakota Department of Agriculture and Natural Resources (DANR) is the lead agency in administering the hazardous waste management program within South Dakota.
