The North Dakota Civil Code (39-21-44) states that rules governing hazardous materials transport must duplicate or be United States Department of Transportation (DOT). The state has adopted by reference the federal Hazardous Materials Regulations (HMR), Title 49, Code of Federal Regulations (CFR), Parts 107 (Subparts F &G), 171 – 173, 177, 178, and Part 180, in effect since February 1, 1999. North Dakota additionally adopted Part 397 of the Federal Motor Carrier Safety Regulations on February 1, 1999, as well asPart 385 Subpart E on April 1, 2008.
The North Dakota Fire Marshal's Office implements regulations for the transportation of hazardous materials and the North Dakota Highway Patrol enforces the regulations within the state.
The North Dakota Department of Environmental Quality (DEQ) is the lead agency in developing and administering a hazardous waste management program within North Dakota.
